Joint Inspection Report prepared by Advisor to the Supreme Court Commissioners
In the light of the Supreme Court order, dated 07th January 2011, joint inquiry team comprising the government officials and representatives of Bihar Advisor to the Supreme Court Commissioners inspected 25 homeless shelters in 5 cities.
The needy poor were not aware about homeless shelters because administration had not done sufficient publicity.
Findings of the enquiry team disclose that all the centres were furnished just a few days before start of the inquiry White washing was done recently & new blankets and bed sheets were found. In most of the homeless shelters basic amenities like toilets, drinking water facility & cleanliness were not found. All shelters lack community kitchen, registration facilities, security, alternative lighting facility during non-availability of electricity and mosquito repellants. There was no separate shelter for destitute, women and children.
We are thankful to government officials, representatives of the Bihar Advisor and poor residents of the shelters home for the contribution in making of this report.

Sir,
You are aware that on 7.1.11 the Supreme Court made an order in the above matter with respect to Bihar which is as follows:
“Learned counsel appearing for the petitioner has shown a number of photographs and filed a report pertaining to the night-shelters. According to the report, night-shelters have not been constructed or erected by the State of Bihar according to the norms. The photographs show that the night-shelters have not been properly erected and basic amenities have not been provided in the night-shelters. The capacity of the night-shelters is also not in consonance with prescribed norms. Mr. Gopal Singh, learned standing counsel appearing for the State of Bihar submits that he will take up the matter with the Chief Secretary of the State today itself and would ensure that all the 51 night-shelters in the State of Bihar are upgraded in consonance with the prescribed norms and basic amenities would be provided in these night-shelters. As a last opportunity, he prays for two weeks time to augment the facilities in the night-shelters.
The State of Bihar must appreciate the intense cold weather in the northern part of India is creating havoc for the poor shelter less people and it is absolutely imperative that these shelters must be upgraded and basic amenities in the night- shelters be provided on priority basis.
In the interest of justice, we grant two weeks' time to ensure that all night-shelters are erected in accordance with the prescribed norms and basic amenities are provided and compliance affidavit to this effect be filed by the Chief Secretary of the State of Bihar. All the concerned authorities are directed to seriously make efforts to comply with this order.
